Current Massachusetts law requires children up to age 5 or 40 pounds to be in a child restraint while riding in a motor vehicle. From ages 5 through 12, only an adult-safety belt is required. The law suggests to parents that it is safe for their children who are 5, 6, or 7 years old to be placed in an adult-safety belt. It is not safe.
Since 2001, AAA Southern New England has been fighting for a bill that requires booster seats through age 7, or up to 4 feet 9 inches tall, whichever comes first. The bill passed the Massachusetts House of Representatives in 2002 by an overwhelming margin. The bill received initial approval in the Senate but died as the clock ran out on the session.
